Speeding charge to be laid against master of Lynx ferry

The master of a Tranz Rail fast ferry is to be prosecuted after allegedly breaching a bylaw restricting ferry speed in the Marlborough Sounds.

Marlborough harbourmaster Alex van Wijngaarden said today the charges would be laid in Blenheim District Court in the next few days.

He alleged the Lynx was recorded travelling between 34 and 37.5 knots over 3km at the entrance to Tory Channel on October 19.

The bylaw, introduced last year amid concern over damage to the Sounds environment from the fast ferries' wash, restricts their speed to 18 knots in the Tory Channel and Queen Charlotte Sound.

The prosecution announced today is the first under that bylaw.

Mr Wijngaarden revealed his decision after reporting to Marlborough District Council yesterday.

A council spokeswoman said Mr Wijngaarden was also considering a further charge under section 65 of the Maritime Transport Act, relating to ships travelling in a manner that resulted in unnecessary danger or risk.

He would announce a decision on that charge after appearing before the council's environment committee over the next month.
