A Hamilton man who allegedly drove off with another man on the bonnet before he fell off and was fatally injured has had a further charge against him thrown out.
Warren Deane died in Waikato Hospital on October 11 after an incident in which he suffered critical head injuries, including a bleed to the brain and a fractured skull, after falling off the bonnet of the 62-year-old driver's car. The accused, who has interim name suppression, is facing charges of manslaughter and failing to stop to ascertain injury.
It is understood he had a further charge that was related to the incident thrown out by a judge yesterday in the Hamilton District Court. The man is to reappear in court on November 15.
Mr Deane, originally from Britain, had just confronted the man after he saw him allegedly dumping rubbish in Naylor St outside his Brookfield Accommodation flat on October 6.
The driver is understood to have retrieved the boxes he was dumping and tried to leave the scene when Mr Deane stood in front of his car and told the man to stay while he called police. The driver fled as Mr Deane grabbed the bonnet of the car.
