A Tuvaluan overstayer and kidney dialysis patient will not learn until December 1 if he will get a second discharge without conviction for beating his wife.
Senee Niusila, 31, appeared in Waitakere District Court today for a progress report on his anger management course and counselling, after he was charged with
beating his wife for the second time.
His lawyer, Nicholas Wintour, wanted Judge Philip Recordon to discharge him without conviction so his immigration status in New Zealand would not be unduly affected.
When he appeared in court last month the court was told Niusila would die within a month, probably two weeks, if he was sent home.
Today, Judge Recordon said Niusila's anger management course and counselling appeared to be going well and he would be remanded until December 1 to consider the application for a discharge without conviction.
