COMMENT:

The land in dispute at Ihumātao has been through a number of legal processes, the last being an appeal on a decision by Heritage NZ to allow modification of an archaeological site. This appeal failed, however, the issue is deeper than just archaeology.

In the court case prior to this, Gavin H. Wallace Ltd & Ors v Auckland Council, the issue was broader. Auckland Council sought to keep the land on the end of the Ihumātao Peninsula, including the Wallace Block, outside the Metropolitan Urban Limit.
