Fatal police shooting: Woman supplied meth to Jerrim Toms for five years before his death

A man was shot on State Highway 1 north of Auckland after coming at police with a machete.

The woman who gave methamphetamine to Jerrim Toms soon before he was shot dead by police north of Auckland at Easter had been supplying him for at least five years.

Court documents released to the Herald reveal Epsom woman Susan Elizabeth Bool met with Toms the day before he died to give him meth after the pair had exchanged a number of text messages to set up the deal.

Bool, 61, recently admitted two charges of supplying and possessing methamphetamine and was sentenced in the Auckland District Court.

The charges came after police linked her to Toms during an investigation into his death.

Toms, 29, died in the early hours of the morning of March 31 near Puhoi after he was shot multiple times by police.

Officers fired at Toms after he allegedly approached police with a machete.

He had earlier approached an officer with the same weapon before fleeing at high speed in his car, turning his headlights off at times.

Police had also been called to his home in Onehunga the night before by a concerned relative.

After his death police said they believed drugs "may" have been a factor in Toms' death.

The Herald revealed that toxicology testing confirmed Toms had methamphetamine in his system when he died.

A source confirmed Toms had an amount of the drug with him at the time.

It is understood Bool is a friend of Toms' family.

Bool was initially granted name suppression - but did not seek to make the order permanent.

Following sentencing Judge Ajit Swaran Singh granted the Herald access to Bool's court file.

According to the police summary of facts police discovered Bool's connection to Toms during the investigation into the fatal shooting.

As part of the investigation police executed production orders on a number of telecommunications companies in relation to Toms' cellphone.

A production order can be granted by the court to allow police access to any information including documents, call-associated data and stored telecommunications, for any offence where a search warrant could be granted.

After checking Toms' phone data, police discovered Bool had been supplying him drugs.

They then sought a production order for her phone.

"Between the 1st of March and the 1st of May Bool was using her mobile phone to facilitate the supply of methamphetamine," the police summary stated.

"A small number of methamphetamine users, mostly appearing to be associates of the defendant, would contact her seeking to obtain methamphetamine.

"Specifically, analysis of the defendant's text messages also show that [Bool] was in contact with [a cellphone number] which has been established to be the phone number of Jerrim Toms."

Text messages obtained by police show Toms messaging Bool on a number of occasions in the days leading up to his death.

The last message exchange happened in the late afternoon of March 30 - just hours before Toms' fatal rampage began.

"Sue have you got another one for me today? I'm after a full one," Toms texted Bool.

On May 1 police executed a search warrant at Bool's Epsom home.

"Adjacent to [Bool's] bed was a make up bag containing approximately one gram of methamphetamine, a used glass pipe of the kind used for smoking methamphetamine, a scoop and empty snaplock bags," said the police document.

"In explanation [Bool] stated that she had been supplying Jerrim with methamphetamine for approximately five years."

Bool told police the methamphetamine they found at her home was for her "own personal use".

Bool was then charged.

Until then she had never been before the courts.

Judge Singh, after considering pre-sentence and medical reports, sentenced Bool to intensive supervision.

He said that due to her mental illness - which he did not elaborate on at sentencing - community work was "not appropriate".

"I have taken into account purposes and principles of sentencing," he said.

"Given your mental health issues, your rehabilitation will be assisted by a sentence of intensive supervision.

"I have given you credit for your early guilty plea.

"Whilst the charges are serious, they are on the lower end of the scale for charges of this nature.

"You have expressed remorse.

"After taking into account all of those matters you are convicted and sentenced to 18 months' intensive supervision."

Bool's sentence includes a number of conditions.

She must not consume any alcohol or drugs not prescribed to her and attend and complete alcohol and drug rehab programmes to the satisfaction of a probation officer.

She must also attend any other counselling or programmes as directed by her probation officer.

The Herald has sought comment from Bool through her lawyer.

Three investigations into Toms' death by the police, coroner and Independent Police Conduct Authority are all ongoing.

Toms' family refuse to speak to the Herald.

They told RNZ that he had been hospitalised and treated for bipolar disorder before his death.

What happened to Jerrim Toms

In the days after Toms died, police release basic information to the media about the chain of events that led to the fatal shooting.

Officers were called to an Onehunga address just after 3am on Saturday, March 31 by a woman reporting that Toms was acting erratically.

She left the property, fearing for her safety.

Police arrived at 3.10am but Toms was not there.

Less than half an hour later, a police officer on his way home from work saw a car pulled over with its hazard lights on, on SH1 north of Auckland.

The car sped off when the police officer approached, and then stopped again.

The officer also stopped and the driver got out and approached the driver's side of the
patrol car.

He had a machete and was threatening the officer.

The officer drove away from Toms and called for backup.

Toms then got back into his car and headed south on SH1 towards Puhoi.

More police, including the Eagle helicopter, were called to help.

Police said Toms was travelling at up to 150km/h and turned off his lights at times.

His car was stopped only after police put down road spikes at Pohuehue about 3.50am.

As officers got out of their car to speak to Toms, he advanced on them, again armed with a machete.

Police shot at Toms and he was struck and killed.

Officers tried first aid and called an ambulance, but Toms died at the scene.

The incident was captured live on multiple cameras.

That footage - from the police Eagle helicopter and other CCTV cameras around the scene - is part of the ongoing investigation.
