4. 6. APN reserves the right to vary these Terms or to modify, suspend, terminate or cancel the promotion.

7. APN reserves the right to verify the validity of any entry. APN may disqualify any person who enters a keyword more than once or copies a coupon or otherwise tampers with the process or fails to comply with these Terms.

8. Online entrants are identified by the email address used to submit the entry. Individuals have rights to access and request correction of their personal information held by APN by calling 0800 100 888. Failure to provide all requested personal information may result in the entry being invalid.'

10. Each entrant agrees that, if he or she wins a prize, his or her details (including name, suburb/town, and photo) may be published in the Herald on Sunday (print and/or online) and used for other publicity purposes.

11. Should the prize winner reside outside Auckland, it will be at the prize winner's expense to travel to Auckland, including all airfares and transfers.

12. All travel is subject to Emirates Airlines and V Australia's standard conditions of contract, standard conditions of carriage, applicable tariffs and regulations prevailing at the time of travel. Both airlines reserve the right to change such terms and conditions at any time. No compensation will be given if an activity is not available due to unforeseen circumstances.

13. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

14. If the winner of the prize is under the age of 18 years the prize will be awarded to the prize winner's parent or legal guardian.

15. The winners are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations, travel insurance and travel documentation. Lounge passes and limousine transfers are not included with this prize.

16. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.

17. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

18. The tickets are non-refundable, non-transferable, non-endorseable and cannot be taken as cash or used for travel on another airline.

19. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

20. As a condition of accepting the prize, the winner (and his/her companion) may be required to sign any legal documentation as and in the form required by the Promoter in their absolute discretion, including but not limited to a legal release and indemnity form.
