Terms and Conditions for The New Zealand Herald and P&O Cruises
'Unsung Community Heroes' Competition 2010:

How To Enter

1 To enter, an entrant must submit an entry by email, post or fax. Each entry should contain no more than 300 words outlining why the person they are nominating (the
"Nominee") deserves to bear the "Unsung Community Hero" title.

2 Each Entry must include the full name and contact details of both the Entrant and the Nominee. Each Nominee must be nominated by an Entrant, and cannot nominate themselves.

3 By Post: Postal Entries should be sent to: Unsung Community Heroes' Competition, NZ Herald, Editorial, PO Box 3290, Auckland City.

4 By Fax: Facsimile Entries should be sent to (09) 373 6406 and be titled 'Unsung Community Heroes' Entry'.

5 Entrants must confirm that the nominee has no objection to information about them being provided to the Herald.

Closing Date: All Entries must be received by 5pm on May 31, 2010.

Prize Details

1 There are five prizes to be won. Each prize will be awarded to a winner.

2 Each prize consists of a cruise holiday aboard P&O Cruises' Pacific Sun for two passengers during the 2011 winter cruise season in Auckland.

3 Each prize must be booked before the date specified in the letter confirming you as a prize winner in order to validate the Prize.

4 Each prize includes: accommodation, main meals, entertainment and facilities onboard Pacific Sun, an on-board credit of NZ$200 and connecting flights to Auckland (from the winner's nearest major city) associated with departure and arrival of the holiday cruise.

5 Each prize does not include other spending money, drinks, other onboard activities including spending money for the casino, shore tours, tips and/or snacks.

6 Each prize will depart from Auckland and return to Auckland at the conclusion of the cruise.

General Terms

1 Who may enter: This promotion is open to New Zealand Residents only. Anyone employed by (or anyone who is an immediate family member of someone employed by) APN, agencies, suppliers or retailers associated with the promotion is ineligible to enter or win. Entrants may only enter Nominees who are over the age of 18 at the time the relevant Entry is submitted.

2 Entries:

a Entries must be received in accordance with the instructions in the How To Enter section and by 5pm on the Closing Date.

b Entries must be accompanied by confirmation that the nominee has consented.

c Entries not complying with the Terms Of Entry, and/or misdirected, late, lost, stolen, incomplete, incomprehensible, or damaged entries are invalid. APN accepts no responsibility for such entries. APN reserves the right to verify validity of any Entry and may in its sole discretion disqualify anyone who tampers with the entry process or acts in a fraudulent or dishonest name.

3 Winners:

a A panel of judges will select five Nominees from all valid entries received for the Unsung Community Heroes Competition and these five Nominees will be the Winners of the five Prizes. A representative from APN NZ Publishing will notify the selected Nominees by telephone within 28 days of the closing date of the Competition.

b Publication of a Nominee's details and/or name during the duration of the competition does not mean that the Nominee is a Winner.

4 Judging Criteria: The panel of judges will be basing their selection to choose the Winners on some or all of the following criteria:

§ Benefits to a particular group: the Nominee whose efforts have had the greatest impact on the group or groups they have chosen to support

§ Benefits to the community at large: the Nominee whose efforts have most significantly benefited the community in which they live

§ Inspiration: the Nominee whose activities have most inspired others to contribute

§ Innovation: the Nominee whose activities best demonstrate initiative and a fresh approach

§ Special circumstances: the Nominee who has overcome difficulties of their own in order to contribute to the welfare of others

§ Length of service to the community

5 Prizes: If any Prize (or part of any Prize) is unavailable, APN, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with another Prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

6 Variations: APN reserves the right to vary the Terms Of Entry or to modify, terminate, suspend or reschedule the promotion.

7 Decisions: APN's decision is final and no correspondence will be entered into.

8 Liability: APN is not liable for any loss, damage, or injury (including without limitation indirect or consequential loss) suffered by any person in connection with the promotion or any Prize, except for any liability under the Consumer Guarantees Act 1993 or other liability which cannot be excluded by law. APN is not responsible for any incorrect information, either caused by the user or any equipment or programming associated with the promotion, or for any technical error, virus or malicious code, or any omission, interruption, defect, delay, or internet, telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of Entries, or for any damage to any person's computer, arising in connection with the promotion. APN takes no responsibility for publishing any untrue, defamatory or libellous material contained in any Entry once consent from the Nominee to publish the contents of the relevant Entry has been obtained by telephone.

9 Privacy Act:

a All entries remain the property of APN. All personal information will be collected, stored and used by APN in accordance with the Privacy Act 1993. APN may use Entrants or Nominees personal information supplied in Entries to conduct this competition or any future competitions or promotional initiatives.

b Each Entrant must submit a completed Nominee Consent Form signed and dated by the Nominee and the Entrant. The Nominee Consent Form will be published in The New Zealand Herald and on the Herald website www.nzherald.co.nz/go/unsungheroes during the competition. The Nominee Consent Form must state that the Nominee consents to the Entrant entering him or her into the Unsung Heroes Competition. Entries submitted without a completed Nominee Consent Form will not be accepted.

c A representative of APN will contact selected Nominees to request consent to publish some of all of the content of the relevant Entry in The New Zealand Herald during the Competition. Nominees' contact details (address and/or phone number(s)) will not be published, and will be used for competition purposes only.

d Nominees, Entrants or anybody else has the right to access, and request correction of, any personal information held by APN.

e By entering the Competition, each Entrant consents to the disclosure of any information submitted in the Entry to the provider of the Prize, being Carnival plc (ARBN 097 786 74, ABN 23 107 998 443, NSW 2TA 4226, trading as "Carnival Australia"). Any personal information disclosed to Carnival Australia will be treated in accordance with their Privacy Policy. Carnival Australia's Privacy Officer can be contacted by writing to Locked Bag 1014 ST LEONARDS NSW 1590, by sending an email to privacy@carnivalaustralia.com or calling our privacy officer on 0800 444 740.

Specific Terms and Conditions in respect of each Prize:

1 Passports, vaccinations, visas and travel insurance are the responsibility of the Winners. Valid passports are required on all P&O Cruises.

2 P&O Cruises is proud to provide facilities for disabled and mobility impaired passengers. There is a limited number of ADA cabins which are specifically designed to accommodate disabled and mobility impaired passengers and they tend to fill quickly. Accordingly, should the prize winner require an ADA cabin this will be subject to availability.

3 P&O Cruises reserves the right, if deemed necessary, to deviate from the ship's advertised route, to delay or cancel part of, or the whole cruise, to remove the ship from service, to charter out the ship/part of the ship or otherwise limit the availability of cabins, in our absolute discretion. In such an event P&O Cruises shall not be required to refund any portion of the fare, make any other compensation or be liable for any other consequential damage, loss, expense, loss of time or inconvenience.

4 The Passenger conditions, as stated in the back of P&O Cruises brochure or available online at www.pocruises.co.nz, including cancellation and liability clauses, apply to the winner. All bookings are subject to availability. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority
