1. Information on how to enter and prizes form part of these Terms and Conditions. Entry into this competition is deemed acceptance of the Terms and Conditions.

2. The competition is open to New Zealand residents only and strictly excludes professional photographers. Professional photographers are deemed to be any person
making money from the sale of their photographs or photographic services. Employees of the Promoters and the Promoters' associated companies and their immediate families are ineligible to enter. Entrants under 18 years of age must have the consent of their parent or guardian to enter the competition.

3. The Promoters reserve the right at their sole and absolute discretion to withdraw, cancel, suspend, modify and/or recommence this competition at any time, including if any their ability to fulfill their obligations is limited at any stage by any form of technical failure or other circumstance outside their control. Any such withdrawal, cancellation, suspension, modification, suspension and/or recommencement shall be notified on the website nzherald.co.nz/union.

4. The Promoters shall have the right to store electronically any pictures sent in by entrants to the competition and to use the images free of charge in any of their online and print publications, plus at the UNION: The Heart of Rugby exhibition and for any promotional use and related merchandise in relation to the exhibition or the UNION: The Heart of Rugby large-format book. In consideration of the prize, each first prize winner also agrees they will not use or publish their photo or allow their winning photo to be used in any exhibition or book or for any other commercial purpose without the prior written consent of the Promoters. Subject to the rights granted to the Promoters, photographers retain the copyright to their photographs but waive all moral rights under the Copyright Act 1994.

5. To enter the competition, entrants must provide their full name and current and valid email address or phone number as well as a photograph taken by the entrant formatted as a jpg and a minimum of 1000 pixels wide.

6. Entrants may enter as many different photographs as they like.

7. Photos must be the property of the entrant and must be of reasonable quality. By submitting the photo, each entrant warrants the photo: (i) is an original, unpublished work; and (ii) does not infringe the intellectual property rights of any third party; and (iii) does not otherwise breach any applicable law. Each entrant undertakes that they will keep their photo confidential and will not publish the photo or allow the photo to be used in any exhibition or book or for any other commercial purpose until the winners of the competition are announced.

8. All photos must be taken in an amateur rugby setting (e.g. school or club game or training). No photos shall be taken at a professional rugby game (domestic or international) or other setting that restricts the use of photographs taken at that game or other setting (e.g. breach of ticket, venue or event conditions). The entrant must obtain the permission of all persons featured in the photo prior to the entry of the photo into the competition.

9. Entries must be received by the Promoters during the Promotional Period. The Promoters accept no responsibility for late, lost or misdirected entries or for any person's inability to complete or continue an entry or for any inaccurate information that may have been supplied or not supplied (as the case may be) as a result of misuse or failure of any equipment, technical error, inaccurate data entry or deletion of data, transmission communication, software limitation or failure, website access, alteration to entry information, or any combination of the foregoing that may occur whilst entering the competition.

10. The competition commences at 8:30am on Monday 6 June, 2011 and will finish at 8:30am on Monday 18 July, 2011. ("Promotional Period"). Entries are deemed to have been received at the time of receipt by the Promoters. The Promoters' records will be final and conclusive as to the time of receipt of an entry.

11. 12 finalists (6 from the Open category and 6 from the College category) will be selected by Promoters by Thursday 21 July, 2011, and the winners will be determined by votes submitted by the public by 8:30am Wednesday 3 August, 2011.

12. The winners will be notified by telephone or email. Inability to contact the winners within fourteen days of the announcement of the winners will result in prize being forfeited.

13. The prizes consist of:

• Copy of the UNION: The Heart of Rugby large-format book.

Open category: Second prize

• TelstraClear products and services to the value of $250 + GST

• Copy of the UNION: The Heart of Rugby large-format book.

Open category: 3rd - 6th

14. The Promoters reserve the right to request such further information as they may reasonably require in relation to any photo or the entrant, including as to the entrant's ownership of the photo or any proof of identification or age. If a winner is under the age of 18 years their parent or guardian must give their prior written consent to the award of the prize.

15. The Promoters' decision is final and no correspondence will be entered into.

16. Any breach of these Terms and Conditions will void an entry. If a breach is discovered after the award of a prize, the Promoters reserve the right to require the return of that prize.

17. The prize is personal to the winner and is not exchangeable or transferable and cannot be taken for cash. If a prize is unavailable for any reason including due to unforeseen circumstances the Promoters may substitute another prize that the Promoters consider, in their sole and absolute discretion, to be of equal value, subject to any directions from a regulatory authority.

18. The winners consent to their name and image being used for public relations and marketing purposes relating to this competition without compensation. Winners also agree to be available for reasonable publicity purposes without compensation. For the avoidance of any doubt, the Promoters have the right to use publicity photos and any other material incorporating the image or likeness of the winners in any reasonable manner they see fit.

19. By ticking the optional box "I am happy for APN (publishers of nzherald.co.nz and The New Zealand Herald) and the promoters of UNION: The Heart of Rugby to email me information and promotions that may be of interest.", entrants acknowledge that they are agreeing to receive future emailed communications from the Promoters. Entrants' personal information will be stored on a database by the Promoters. A request to access, update or correct any information should be directed to the Promoters at the addresses set out below.

20. To the extent permitted by law, the Promoters will not be liable for any loss or damage whatsoever (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained during the course of accepting or using the prizes or otherwise as a result of the competition.

21. To the fullest extent permitted by law, the Promoters' total liability, whether for breach of these conditions or in negligence or for any other tort or for any other common law or statutory cause of action arising in relation to the competition or the prizes, is limited to $1,000.

22. These Terms and Conditions may be amended from time to time by notification on the website www.nzherald.co.nz/union.
