Terms and Conditions
1. Information on How to Enter and all details on the competition ad form part of these Terms. To the extent of any inconsistency, the Terms below prevail.
By entering, readers accept these Terms. Entry is open to NZ residents only aged 18 years and over. Anyone employed by (and any immediate family members, participating agents and associated agencies) APN and Auckland Racing Club ineligible to enter. APN is APN New Zealand Limited (and its related companies).
2. Entries close 12.01am, Thursday, December 17, 2009. Only one email per email address will be accepted as a valid entry. The draw will take place on Thursday, December 17, 2009. The winner will be notified by phone. If the prize winner is under 18 the prize will be awarded to their parent or guardian.
3. All entries are deemed received at the time of receipt by APN (for email entries, when received in to APN's "winwiththeherald@nzherald.co.nz" email inbox and NOT at time of transmission by the entrant). APN's records are conclusive as to time of receipt. Late, lost, stolen, misdirected, illegal, incomplete, illegible, damaged, reproduced, or altered entries are invalid. APN is not responsible for such entries nor for any error, technical malfunction, loss, omission, communications delay or failure.
4. The prize winner will win the following: (1) A table for eight people in the Viva Fashion Village on Boxing Day, Saturday 26th December, 2009, including a glass of Methode-Traditionelle or Stella Artois on arrival and a bottle of bubbles for the table, cash bar facilities, privates to totes, Racecourse admission, Racebook and pen. Cash bar and café style food is available for purchase and not included with the prize; (2) A headpiece from Natalie Chan valued at $200. Style and design to be dertermined by the promoter; (3) A $500 voucher for JET Streetwear and (4) A FujiFilm Finepix Z35 with a 2GB memory card, 2GB USB thumb drive and case.
5. Prize must be taken on the raceday specified upon entry. If the winner is unable for any reason to attend on that raceday, the prize in whole will be forfeited.
6. The winner is responsible for paying all additional costs associated with the prize that are not specifically included, including (where applicable) transport, airport transfers, accommodation, meal costs, spending money, insurance and all other incidentals.
7. Prize is non-transferable and non-redeemable for cash. Any attempt to resell or auction all or part of this prize will result in immediate cancellation of the prize.
8. The major prizewinner will be notified by phone in the first instance and then by post in the form of a winner's confirmation letter. If the prize is not claimed within 5 days of the draw, APN may re-draw a new winner of the prize. APN's decision is final and no correspondence will be entered into.
9. APN and Auckland Racing Club are not liable for any loss, damage or injury (including without limitation indirect or consequential loss) suffered by any person in connection with the promotion or any prize, except for any liability under the Consumer Guarantees Act 1993 or other liability that cannot be excluded by law.
10. The Promoters reserve the right to vary these Terms or to modify, suspend, terminate or cancel the promotion.
11. The Promoters reserve the right to substitute the prize in whole (or any of its components), with a substitute prize of equal or greater value.
12. If any part of the race day including, without limitation, any race, performance or event is cancelled, abandoned or postponed, in whole or in part, for any reason whatsoever that is beyond Auckland Racing Club's control, including, without limitation, due to adverse weather conditions, there is no right to refund or exchange and no obligation is assumed by Auckland Racing Club for the arrangement of a substitute event, performance or any other element.
13. The serving and consumption of alcohol at the event is subject to Liquor Licensing laws and requirements.
14. APN reserves the right to verify the validity of any entry. APN may disqualify any person who tampers with the process or fails to comply with these Terms.
15. Entries become the property of APN. In accordance with the Privacy Act 1993, APN collects and holds personal information to conduct the promotion, notify prize winners and verify verify prize winners' identities and the information may be used for future promotional activities. Individuals have rights to access and request correction of their personal information held by APN by calling 0800 100 888. Failure to provide all requested personal information might result in the entry being invalid.
16. By accepting the prize, the winner consents to the promoter using his/her details and photographs for promotional and media publicity purposes.
