Terms and Conditions
1. Information on How to Enter and all details on the competition ad form part of these Terms. To the extent of any inconsistency, the Terms below prevail. By entering, readers accept these Terms. Entry is open to NZ residents only aged 18 years and
over. Anyone employed by (and any immediate family members, participating agents and associated agencies) APN, Auckland Racing Club and The Edge are ineligible to enter. APN is APN New Zealand Limited (and its related companies).
2. Entries close 5pm, Monday February 23, 2009. Readers may enter as many times as they wish, as long as each entry is on an original entry coupon (no photocopies accepted) and posted in a separate envelope. The draw will take place on Tuesday, February 24, 2009.
3. The prize winner will win: Hospitality for 4 in the Mercedes Fashion Village on Telecom Derby Day, Saturday 28th February, 2009; Chauffeur driven Mercedes-Benz to and from Telecom Derby Day; 4x Opening Night tickets to My Fair Lady on Thursday 26th March, 2009; Entry for 4 to the invitation-only My Fair Lady Opening Night Party; 4 My Fair Lady programme books; 4x Drinks vouchers for The Civic on Opening Night; and 4x DVDs of the My Fair Lady movie.
4. Prize must be taken on the raceday specified upon entry. If the winner is unable for any reason to attend on that raceday, the prize in whole will be forfeited.
5. The winner is responsible for paying all additional costs associated with the prize that are not specifically included, including (where applicable) transport, airport transfers, accommodation, meal costs, spending money, insurance and all other incidentals.
6. Prize is non-transferable and non-redeemable for cash. Any attempt to resell or auction all or part of this prize will result in immediate cancellation of the prize.
7. The major prizewinner will be notified by phone in the first instance and then by post in the form of a winner's confirmation letter. If the prize is not claimed within 5 days of the draw, APN may re-draw a new winner of the prize. APN's decision is final and no correspondence will be entered into.
8. The runner-up winners will be notified by phone and/or post.
9. APN are not liable for any loss, damage or injury (including without limitation indirect or consequential loss) suffered by any person in connection with the promotion or any prize, except for any liability under the Consumer Guarantees Act 1993 or other liability that cannot be excluded by law.
10. All entries are deemed received at the time of receipt by APN, i.e. when received in to APN's "Win with the Herald" database and NOT at time of transmission by the entrant). APN's records are conclusive as to time of receipt. APN is not responsible for such entries nor for any error, technical malfunction, loss, omission, communications delay or failure.
11. The Promoters reserve the right to vary these Terms or to modify, suspend, terminate or cancel the promotion.
12. The Promoters reserve the right to substitute the prize in whole (or any of its components), with a substitute prize of equal or greater value.
13. APN reserves the right to verify the validity of any entry. APN may disqualify any person who tampers with the process or fails to comply with these Terms.
14. Entries become the property of APN. In accordance with the Privacy Act 1993, APN collects and holds personal information to conduct the promotion, notify prize winners and verify verify prize winners' identities and the information may be used for future promotional activities. Individuals have rights to access and request correction of their personal information held by APN by calling 0800 100 888. Failure to provide all requested personal information might result in the entry being invalid.
15. By ticking the optional box on the entry coupon "The New Zealand Herald may contact you for future marketing activities - Please tick here if you would like to be contacted by email", entrants acknowledge that they are agreeing to receive future email, postal or phone communications from The New Zealand Herald. Entrants' personal information will be stored on a database by APN.
16. By accepting the prize, the winner consents to the promoter using his/her details and photographs for promotional and media publicity purposes.
