Terms and conditions for Rugby World Cup 2011 Photo Competition:
1.Information on how to enter and prizes form part of these Terms and Conditions. Entry into this competition is deemed acceptance of the Terms and Conditions.
2.The competition is open to New Zealand residents only and strictly excludes professional photographers. Professional photographers are deemed to be any person making money from the sale of their photographs or photographic services. Employees of the Promoters and the Promoters' associated companies and their immediate families are ineligible to enter. Entrants under 18 years of age must have the consent of their parent or guardian to enter the competition.
3.The New Zealand Herald and Research in Motion Limited (BlackBerry) reserve the right at their sole and absolute discretion to withdraw, cancel, suspend, modify and/or recommence this competition at any time, including if any their ability to fulfil their obligations is limited at any stage by any form of technical failure or other circumstance outside their control
4.The New Zealand Herald shall have the right to store electronically any pictures sent in by entrants to the competition and to use the images free of charge in any of their online and print publications.
In consideration of the prize, each first prize winner also agrees they will not use or publish their photo or allow their winning photo to be used in any exhibition or book or for any other commercial purpose without the prior written consent of the Promoters. Subject to the rights granted to the Promoters, photographers retain the copyright to their photographs but waive all moral rights under the Copyright Act 1994.
5.To enter the competition, entrants must provide their full name, current and valid email address and phone number along with their photograph submission. The photograph needs to be in jpg format and a minimum of 1000 pixels wide.
6.Entrants may enter as many different photographs as they like.
7.Photos must be the property of the entrant and must be of reasonable quality. By submitting the photo, each entrant warrants the photo: (i) is an original, unpublished work; and (ii) does not infringe the intellectual property rights of any third party; and (iii) does not otherwise breach any applicable law. Each entrant undertakes that they will keep their photo confidential and will not publish the photo or allow the photo to be used in any exhibition or book or for any other commercial purpose until the winners of the competition are announced.
8.Entries must be received by The New Zealand Herald during the Promotional Period. The New Zealand Herald accepts no responsibility for late, lost or misdirected entries or for any person's inability to complete or continue an entry or for any inaccurate information that may have been supplied or not supplied (as the case may be) as a result of misuse or failure of any equipment, technical error, inaccurate data entry or deletion of data, transmission communication, software limitation or failure, website access, alteration to entry information, or any combination of the foregoing that may occur whilst entering the competition.
9.The competition commences on September 9, 2011 and closes on October 21 ("Promotional Period"). Entries are deemed to have been received at the time of receipt by the Promoters. The Promoters' records will be final and conclusive as to the time of receipt of an entry.
10.The winning photographs will be judged by The New Zealand Herald editorial team and the winning entrants will be notified by telephone, email or post.
11.There will be six winners one each week for six weeks, each winner will receive a BlackBerry PlayBook tablet valued at $799.00 thanks to BlackBerry.
12.The New Zealand Herald reserves the right to request such further information as they may reasonably require in relation to any photo or the entrant, including as to the entrant's ownership of the photo or any proof of identification or age. If a winner is under the age of 18 years their parent or guardian must give their prior written consent to the award of the prize.
13.The New Zealand Herald's decision is final and no correspondence will be entered into.
14. Any breach of these Terms and Conditions will void an entry.
15. The prize is not exchangeable or transferable and cannot be taken for cash. If a prize is unavailable for any reason including due to unforeseen circumstances Research in Motion Limited (BlackBerry) may substitute another prize that the Promoters consider, in their sole and absolute discretion, to be of equal value, subject to any directions from a regulatory authority.
16. The winners consent to their name and image being used for public relations and marketing purposes relating to this competition without compensation.
17. To the extent permitted by law, The New Zealand or Research in Motion Limited (BlackBerry) will not be liable for any loss or damage whatsoever (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained during the course of accepting or using the prizes or otherwise as a result of the competition.
