1. Information on how to enter the promotion forms part of the conditions of entry. Entry into the promotion is deemed as acceptance of its terms and conditions.
2. Entry is only open to New Zealand residents, except employees (and such employees' immediate families) of NZME. Limited and agencies associated with
the weekly giveaways.
3. How to Enter: Entry into a Herald competition requires a person to complete the online entry form in full.
4. In accordance with the Privacy Act 1993, NZME. collects personal information and the Promoter holds personal information to conduct the giveaway, notify prize winners, verify prize winners' identities and may be used by the Promoter, for future promotional activities. Individuals have rights to access and request correction of their personal information held by NZME. by calling NZME. on 09 373 6400. Failure to provide all requested personal information may result in the entry being invalid.
5. Entrants are identified by the email address used to subscribe. Any prize won by a web entrant will be awarded to the holder of the email address (or that person's parent/guardian if the winner(s) is/are under 18 and the nature of the prize requires the winner(s) to be over 18 years of age) from which that entry was submitted. The Promoter takes no responsibility for disputes resulting from email newsletter subscriptions and entries submitted using an email address belonging to any other person.
6. Winners must be over 18 years of age.
7. The competition runs from 9am Monday, April 25 to 11:59pm Sunday, May 8, 2016. Winners will be notified by phone, email. Prizes cannot be exchanged for cash, credit or service and no exchange communications will be entered into. Winners will be randomly drawn within one week of the competition closing date. If the prize has limited date validity and is not claimed within the necessary timeframe the Promoter may re-draw a new winner.
8. Each entrant agrees that, if he or she wins a prize, his or her details (including name, suburb/town, and photo) may be published in the Herald (print and/or online) and used for other publicity purposes.
9. Prize Details: One (1) prize winner will win a trip for two (2) to the American Express Queenstown Winter Festival. This travel package includes;
- Return flights to Queenstown Airport, departing from either Auckland, Wellington or Christchurch Airport. Departing Friday, June 24 returning Sunday, June 26
- Accommodation for two nights at the Hilton Queenstown Resort & Spa
- Tickets for two to the American Express Comedy Debate
- Two-day lift passes for Coronet Peak and The Remarkables, including ski or board hire
- Car Rental from JUCY Rentals
10. This Travel prize needs to be taken between: Friday, June 24 and returning Sunday, June 26.
11. It is each winner's responsibility to cover any additional costs associated with the prize not specifically stated in clause 9, and to arrange passports, visas, insurance and travel to and from Queenstown if they do not reside in Queenstown. All travel prizes exclude travel/transport to and from Queenstown airport, meals and beverages. Spending money and all other ancillary costs are the responsibility of the winner.
12. In the event that any prize(s) become unavailable for any reason beyond the Promoter's control, the Promoter may substitute a prize of equal or greater value. The prize is not transferable or exchangeable and cannot be taken as cash. Any unused portion of the prize is non-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
13. In the event the prize winner requests a travel prize of greater value than that specified (e.g. requests an extended length of stay), the prize-winner shall pay the difference in value and no claim for the difference shall be made against any of the promotional partners.
14. Taking the prize is subject to any prevailing terms and conditions of the accommodation/ transport/ services (as applicable), and in particular, health, behaviour, age and safety requirements. No compensation will be payable if the winner, or their travel companions, are unable to use any element of the prize as stated for whatever reason, including participation in certain activities for health, age, behaviour or safety reasons. Any part of a prize that is not taken for any reason is forfeited.
15. The winner and their travel companion will not accrue any frequent flyer points from taking the prize. All components of the prize must be taken together. Any element of the prize not taken will be deemed to be forfeited. Accommodation and travel is subject to booking, accommodation and flight availability. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner.
16. All entries are deemed received at the time of receipt by NZME's database and NOT at time of transmission by the entrant. NZME's records are conclusive as to time of receipt. Late, misdirected, illegal, incomplete or illegible, are invalid. NZME is not responsible for such entries nor for any error, technical malfunction, loss, omission, communications delay or failure.
17. The Promoter reserves the right to vary the terms, and to modify, terminate or reschedule the Competition.
18. The Promoter is not liable for any loss, damage or injury (including and without limitation any indirect or consequential loss) suffered by any person in connection with the Competition and prize, except for any liability under the Consumer Guarantees Act 1993 or other liability that cannot be excluded by law.
19. By entering into this promotion you expressly consent to receiving promotional offers from the Promoter. Such promotional offers will be sent to the email address or to the delivery address that you have provided in completing the promotion entry form.
