A Wellington human rights lawyer has won a case on behalf of five homeless people accused of breaching a trespass notice.
They had been banned from the capital's Glover Park after complaints they were using it as a toilet.
However the judge hearing the case has ruled there was a lack of identification as well as conflicting evidence from witnesses.
Lawyer Michael Bott says those involved in issuing the trespass notice also ran foul of the Bill of Rights.
