LOS ANGELES - Bra Boy surf gang leader Koby Abberton has agreed to a plea deal with US prosecutors.
Sydney-based Abberton was scheduled to appear in Hawaii's Kaneohe District Court tomorrow, but his lawyer and prosecutors came to an eleventh hour agreement today.
The details of the deal will remain confidential until November 20, when Abberton is due to appear before Judge Ray Graulty and confirm he has agreed to a deal.
Abberton had originally entered a not guilty plea to a third degree assault charge.
Prosecutors allege he punched an off-duty police officer outside a Honolulu nightclub in March.
"There is an agreement," spokesman for the Honolulu prosecutor's office Jim Fulton said.
"He will now have to return on November 20 for his change of plea."
Fulton said the deal was currently an oral agreement so Abberton could change his mind.
"If for some reason he reneges on that then he would have to go to trial," Fulton said.
The third degree assault charge has a maximum sentence of a year in a US jail, but it is unlikely Abberton will be sentenced to prison.
Fulton said the deal would not be made public until signed.
Abberton, 30, is accused of punching 27-year-old off-duty officer Richard Puu outside Honolulu's Epic nightclub in the early hours of March 8.
Puu told authorities he was hit while trying to break up a fight involving Abberton.
Abberton, a professional surfer, had said in media interviews he was a victim of mistaken identity.
Abberton and his brothers received worldwide notoriety this year with the global release of their documentary, Bra Boys, which featured Oscar winner Russell Crowe as narrator and focused on their violent upbringing on Sydney's southern beaches.
