Act leader Richard Prebble has come out fighting over the gagging writ brought against him by New Zealand Post.
Politicians are usually immune from being served with writs while they are at Parliament.
However, Mr Prebble says he will receive the papers this afternoon and will then fight what he sees as a freedom of speech issue in court.
In the meantime Mr Prebble says he will abide by the court's ruling, and not release information from the leaked copy of New Zealand Post's business plan for the so-called People's Bank.
National leader Jenny Shipley earlier this week shredded her copy of the plan after objections were raised by Alliance leader Jim Anderton.
Mr Prebble expects to appear in court tomorrow.
