An Instagram star has won a legal battle with a Sydney dating agency which she claims sent her on a dud date.

Zoe Daly, a fitness model who has 214,000 Instagram followers said she was promised she would meet "amazing men" when she handed over A$5000 (NZ$5500) to private matchmaking service Elite Introductions on November 7 last year, according to the Daily Telegraph Australia.

Ms Daly told the Civil and Administrative Tribunal said she hoped to meet, "like-minded, ambitious, successful, professional men."

Instead she claimed she was set up with a man who looked much older than her specified 32 to 38 age range and who, "spoke about himself the whole time."

Ms Daly said her date was "negative", "not passionate about his job", showed little interest in her and even insulted her about her car.

Afterwards Ms Daly tried to get her money back on her A$4995 (NZ$5470) , 12-month membership.

She took her case to the NSW Civil and Administrative Tribunal in her quest for a refund.

Elite Introductions owner and self-proclaimed "Millionaire Matchmaker" Trudy Gilbert submitted to the Tribunal that Daly should have gone on more dates.

Ms Gilbert said Daly had, "unreasonably formed the view that not even a year of introductions ... could lead to a better outcome."

She said a 12-month member would receive about eight to 10 introductions, or one about every five to six weeks over the course of a year.

The Tribunal decided to award Daly an 80 per cent refund of A$4000 (NZ$4380).
