Things are going from bad to worse in the nasty custody battle between actress

The exes are currently involved in a custody fight involving their 2 1/2-year-old daughter

Nahla

The proverbial hit the fan when Aubry filed court papers in December to establish paternity, and to seek joint custody. This was the first major red flag that relations between the ex-lovers had turned sour, and that attempts to establish custody and visitation rights between them had failed.

Insiders had claimed that the pair, who split in April 2010, had remained civil while co-parenting their daughter. But after Aubry's filing, the battle lines were drawn.

Berry fired a salvo earlier this week, announcing that she had pulled out of a film so she could focus on the looming court battle.

"Halle Berry was forced to pull out of a film production in New York this week due to pending custody litigation involving her daughter," said the star's rep.

"She has attempted to resolve these custody issues amicably with her daughter's father, Gabriel Aubry, directly, but given his lack of cooperation, Halle has no choice but to seek swift judicial intervention."

Berry topped it off with an ominous statement. The rep added: "Halle has serious concerns for her daughter's well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her."

Total tosh, says Aubry, who fired back via his rep.

"While Gabriel is disappointed in Halle's decision to falsely malign him publicly and for her own purposes, he refuses to be pulled into her dispute over a canceled film production," the rep said in a statement.

"Gabriel also refuses to air their issues in the press as he believes this may ultimately harm their daughter.

"The fact is that Gabriel is a caring father who shares custody of Nahla. Gabriel fully believes that a consistent and balanced living situation and two loving parents are crucial for their child even if Ms. Berry feels otherwise," the statement adds.

"He will always defend his rights as a father and will always consider Nahla's best interest. Halle's continuing allegations in the press are untrue and irresponsible."

Team Berry then rallied the troops and

hurled an accusation

that Aubry had allegedly let rip with a sea expletives and race-based hatred toward Berry during their relationship.

An ex-girlfriend of Aubry also

crawled out of the woodwork

and reportedly accused the male model of being "borderline racist," claims TMZ.

tells RadarOnline

that such accusations are nonsense.

Now it's Aubry's turn. The Canadian model is reportedly in possession of a handful of nasty voice mails, e-mails and text messages from Berry, which "document her angry and jealous rages," according to Radar.

In one email the actress allegedly wrote, "You were only good for one thing... Thanks for the donation," according to the website.

For what it's worth, a source says Aubry is opting not to release the messages to the press, but will instead save them for family court, where they won't be disclosed to the public.

"I honestly think Gabriel should release some of these messages he has from Halle and tell his side of the story, but he won't," a source tells Radar. "He said he's going to save them for family court, which will be a private, press-free environment."

has also been dragged into the bitter battle.

The socialite and Aubrey were

snapped

at a Los Angeles Lakers game last November, prompting speculation they were an item.

A source at the time said they were "dating a little bit."

Berry saw red and reportedly went off on one.

"Halle was very upset," a gossip

told People

"She was upset at the idea of someone like that being in her daughter's life. She did not want a reality star in Nahla's life. She was very aggravated.

"Halle couldn't care less who Gabriel dates. She just didn't want Nahla exposed to the cameras that are undoubtedly around a reality star."

But a source says Berry jumped the gun and spat the dummy over nothing.

"Gabriel wanted to make sure he dated someone for six months before he introduced them to his daughter. There was never for a second a thought by Kim or Gabriel that Nahla would ever go near cameras."
