After weeks of protected sex, the woman alleges they eventually had unprotected oral sex and on October 26, 2015, they had unprotected intercourse for the first time.
After they had unprotected sex, Sheen allegedly told her he was in fact HIV positive and gave her two pills to prevent transmission of the disease.
It also alleges he didn't tell her about being HIV positive because it was "none of her f**king business".
The suit quotes him saying "This is more about ... not if, but when you do come down with this [HIV], that we're together and at least we have each other".
This isn't the first time Sheen has been hit with a lawsuit over having HIV.
In December, 2015 his former fiance Scottine Ross filed a lawsuit against Sheen alleging the actor exposed her to HIV.
The case was referred to arbitration.
Sheen sat down with The Today Showin 2015 to address his diagnosis, telling the US morning show he'd paid millions to keep people quiet after he'd become a victim of betrayal and extortion. He said he'd paid upwards of $US10 million ($14 million) in hush money.
"I have to put a stop to this onslaught, this barrage of attacks and of sub-truths and very harmful and mercurial stories that are about me, that threaten the health of so many others that couldn't be further from the truth," the Red Dawn star said.
"I've paid people. Not that many but enough where it has depleted the future ... enough to bring it into the millions ... that's money they're taking from my children," he said.
Sheen said that after coming clean on live TV, he was releasing himself from a "prison" and he would no longer pay people for silence.
