The latest houses on The Block NZ will go to auction on live television tomorrow night despite not having final sign off from the council.
As the hammer falls at the Grand Millennium Hotel in Auckland the Code Compliance Certificate for the four North Shore houses has not been appliedfor because there is building work to complete.
The Land Information Memorandum for the site at 58 Potter Ave, Northcote shows the final sign off for the foundations and the building consent is outstanding.
Auckland Council confirmed the application for a Code Compliance Certificate had not been submitted.
It is legal to sell a house without the certificate but it had to be applied for within two years of the building consent being granted or it could be refused.

Philippa Rennie from production company Warner Brothers said there was absolutely no issue with the CCC and it would be applied for and issued soon.
"It is not unusual to sell a home in New Zealand pending Code Compliance - thousands of houses are sold like this every year," Rennie said.
She said all the prospective buyers would know from the Sales and Purchase Agreement that settlement was on October 20 or five days after the issue of Code Compliance, whichever came first.
"There will certainly not be any difficulty obtaining certification as the houses have been completed to a very high standard," she said.
The site was purchased by Eyeworks New Zealand Limited, the production company also known as Warner Brothers NZ, for $1.9 million in July 2016.
The original two storey weatherboard house on the 926 sqm site was bowled and four identical units were built in April this year.
The Northcote houses are the biggest Block houses yet, have roof-top gardens and boast views over the harbour and Rangitoto.
The largest house is 262 sqm and has been finished by brothers Levi and Zach Inglis, better known as Ling and Zing.

Three other teams included identical twins Julia and Ali Heaney from Auckland, friends Stacey Cottrill and Yanita McLeay from Palmerston North, and brothers-in-law from Hamilton Andy Murdie and Nate Ross.
The sixth season of the popular TV3 home improvement show differed from previous seasons where teams renovated existing structures.
The site is zoned for Terrace Housing and Apartment Building under the intensification focused Auckland Unitary Plan Operative in Part.
Houses in the street have recently sold for between $750,000 to $1.1m but The Block NZ houses are expected to sell for much more.
The winner of The Block NZ is the team whose house sells for the most over reserve. They win $100,000 and any profits above reserve.
