Christchurch-based cookie maker Cookie Time says it will not rely on good faith and an interim injunction to keep a competitor's product off shelves.
Last week, Cookie Time won an injunction against Griffins, which has been ordered to remove its Holiday Wee Chocolate Chippie buckets from sale because
of their similarity to Cookie Time's bite size Christmas cookie product.
Cookie Time says it will also seek full restitution in the High Court if an out-of-court settlement cannot be reached. Cookie Time has been awarded $75,000 in costs, but spokesman Guy Pope-Mayall says he will seek more in costs, as well as damages, unless Griffins "changes [its] attitude."
"It's definitely not over," Mr Pope-Mayall said yesterday. "The courts have only ruled on an interim situation - they have not addressed the issue of damages."
But Griffins managing director Tony Nowell says the matter will go no further.
"We were disappointed with the decision, [but] pleased the court didn't give ownership of the traditional red and green festive season colours to a single party."
