Enza letting export permit battle rest

Main apple exporter Enza will not challanege a High Court decision allowing export permits to be issued to independent marketers.

On Monday, the court ordered the lifting of Enza's nearly two-week-old interim injunction against the export permits committee. But it gave the company until 10 am yesterday to appeal.
A company spokesman said no appeal would be made.

The permits committee welcomed Enza's decision and said it would now be able to issue export permits.

Most of the consents for the 2.4 million cartons of apples it had already approved were caught by the injunction and could not be issued to marketers while it was in place.

Justice John Doogue said Enza did not have a strong case, in the context of the legal framework.
