Rotorua police will speak to the Rotorua Crown solicitor in relation to their investigation surrounding the death of a boy at Kuirau Park.
Toromon Toromon, of Hamilton, died earlier this month after he fell into one of the hot pools and suffered severe burns before being pulled out by his older brother on Boxing Day.
Detective Senior Sergeant Mark Loper of Rotorua police said the boy's family had been spoken to, as well as a number of witnesses, and the police were to speak to the Crown solicitor before referring the matter to the coroner. Mr Loper would not comment on why police would be speaking to the Crown solicitor. Since the incident, the Rotorua District Council has erected a 1.2m fence around the pool in which Toromon fell, suffering severe burns. He died several days later.
Both police and the council have been investigating the incident.
The council's district engineer, Nico Claassen, told The Daily Post a permanent wooden thermal fence was erected last week around the pool, which was also blocking an area where people were previously able to walk.
Since the Boxing Day incident, a 1.8m temporary fence had been put up around the pool before it was replaced by the 12m-long wooden fence.
The original 1m stone fence around the 4m by 3m pool had previously acted as a barrier.
The pool had a stone fence as its water level fluctuated, Mr Claassen said.
It was the only pool with a stone fence left in the park.
A new wooden thermal fence, similar to those around other pools in the park, had been erected to prevent anyone else falling into the pool.
"From our point of view, we just want to minimise the risk of such a horrific incident happening again," Mr Claassen said.
He said all of the 60 signs, which the council said earlier this month it would be putting up, had been erected.
The council's investigation had been completed and it would now wait for the inquest and any recommendations from the coroner.
Based on an observation by The Daily Post, it appeared that it would not have been difficult to get into the pool before the wooden fence was erected.
Mr Claassen said it was not appropriate to comment on the specifics of what happened while police were investigating.
"Lets wait for the facts."
A spokesman for Rotorua coroner Wallace Bain said police were making detailed inquiries on behalf of the coroner before a date would be set for an inquest.
