Ban for four time drink driver

A Whangarei driver has been banned from the roads and ordered to serve community detention for his fourth drink-driving conviction.

John Daniel KELLY, 49, who worked as a driver, appeared for sentence in the Whangarei District Court on a charge of driving with excess breath alcohol for a third or subsequent time, after he was stopped on McLean Rd, Waipu, just after 11pm on September 16.

A breath test showed Kelly had a level of 695 micrograms of alcohol per litre of breath. The legal limit is 400mcg.

He was sentenced to four months' community detention, 12 months' supervision, 100 hours' community work, and disqualified from driving for 15 months for his fourth drink-driving conviction since 2000.

Northland has some of the highest rates of drink-driving in the country, particularly repeat offenders, and the Northern Advocate is publishing its "name and shame" list of all people convicted of drink driving offences in the region. Also sentenced in Northland's courts recently were:

Ngawati James Paul WILSON, 25, 542mcg, one months' imprisonment, disqualified from driving for six months.

Gertrude Martha Maria ERMENS, 45, 836mcg, $800 fine, disqualified from driving for six months.

Paraire Richard RAKO, 42, unemployed, 979mcg, 120 hours' community work, 12 months' supervision, disqualified from driving for nine months.

Evan George PANNETT, 24, 578mcg, $500 fine, disqualified from driving for six months.

Cecilia Anne RAFTSTRAND, 31, mother, 904mcg, $850 fine, disqualified from driving for six months.

Betty Anne ABRAHAM, 77, 815mcg, 50 hours' community work, disqualified from driving for six months.

Rhys Peter BOYLAN, 20, 159 milligrams of alcohol per 100 millilitres of blood, $900 fine, disqualified from driving for eight months.

Limits - Aged 20 and above: 400mcg of alcohol per litre of breath; 80mg of alcohol per 100ml of blood. Under 20: blood alcohol limit of between 0.00 and 0.03, $200 and 50 demerit points. Over that, same penalties as adults.
