Double-murder accused Chris Kahui will stay behind bars tomorrow while his legal team try to get his bail address moved to Northland after revelations that he was in regular contact with an eight-year-old girl when previously on bail.
Kahui was due to be bailed tomorrow into the care of an Auckland pastor, who had cared for him when he had been previously bailed, following a High Court hearing last week.
Concerns were raised after police were told Kahui had regular contact while previously on bail with the girl, whose mother, the pastor's daughter, was believed to have begun a relationship with Kahui.
Kahui, 22, is accused of murdering his twin babies Cru and Chris last year. Police are understood to have spoken to Kahui over his association with the eight-year-old last week.
Kahui's lawyer Lorraine Smith said her client would not be released on bail tomorrow as was previously ruled.
She is seeking a telephone conference with court, police and Crown representatives today and hopes her proposal of a Northland address for him to be bailed to will be approved without having to return to court.
"We are talking to some people in the church in Northland and think he would be better off if he is away from Auckland."
Ms Smith said the latest concerns surrounded contact Kahui was believed to have had with the child when he was on bail previously but which were not known until the child's father raised them with police a couple of days ago.
She said Kahui was naive and the allegations of his contact with the girl was not a good look.
"I don't want any more hiccups and we want him away from places where there is a risk of further potential breaches of bail. I'm very grateful the Catholic Church in Northland has come forward and they will be able to provide a solid and stable environment."
Kahui had first been bailed in November to a place outside of Auckland. Ms Smith said he thrived there but changed circumstances with his caregivers there meant a new bail address was needed, which is how he came to be with the pastor in Auckland.
Kahui was remanded in custody after he was arrested for a third breach of his bail conditions. However, Justice Paul Heath granted him bail last week under a new law which directed judges to do this unless the suspect was seen as a flight risk, a risk of interfering with witnesses or evidence, or a risk of offending.
