A group of asylum-seekers who were jailed during the security crackdown for the Apec summit last year want to take a case to the Privy Council.
The 13 men are from Iran, India and Pakistan.
In December, the High Court ruled that all asylum-seekers had a legitimate expectation of being given temporary permits at the border. However, last week the Court of Appeal overturned that decision.
The Refugee Status Appeals Authority has allowed four of the men to stay in NZ and told seven to leave. Their lawyer, Rodney Hooker, argues that an appeal to London against the Appeal Court ruling would mean that the seven would effectively be on bail until a final decision was made.
