Man who is 'not a legal person' barred from lodging appeals

A man who claims in court that he is not a legal person has been barred from lodging any further appeals through the courts.

Malcolm France fell off his moped in Auckland and refused to give his name and address to police, who later found out he had no license and was banned from driving.

Following a lengthy court battle, in which he appeared in court claiming to be someone else who was acting on his behalf, the court registry has been instructed to not receive any further documents from France in relation to the matter.

France made an application to recall a judgment from the Court of Appeal that rebuked his attempt to overturn his conviction.

The application to recall was filed on the grounds that France was "not a legal person" and wasn't aware of the hearing date in the Court of Appeal in June.

The Court of Appeal said the application for recall contained "more of the nonsense" that he presented to the court in the decision he wished to recall.

Papers filed by France previously in court were called "largely incomprehensible and meaningless" by the court, and no grounds to admit a recall were established.

The matter was finished, the Court of Appeal said.
