Rotorua police will speak to the Rotorua Crown solicitor in relation to their investigation surrounding the death of a boy at Kuirau Park.
Toromon Toromon, of Hamilton, died earlier this month after he fell into one of the hot pools and suffered severe burns before being pulled out by his olderbrother on Boxing Day.
Rotorua Detective Senior Sergeant Mark Loper said the boy's family had been spoken to, as well as a number of witnesses, and the police were to speak to the Crown solicitor before referring the matter to the coroner. Mr Loper would not comment on why police would be speaking to the Crown solicitor. Since the incident, the Rotorua District Council has erected a 1.2m fence around the pool in which Toromon fell, suffering severe burns. He died several days later.
Both police and the council have been investigating.
The council's district engineer, Nico Claassen, said a permanent wooden thermal fence was erected last week around the pool, which was also blocking an area where people were previously able to walk.
Since the Boxing Day incident, a 1.8m temporary fence had been put up around the pool before it was replaced by the 12m-long wooden fence.
The original 1m stone fence around the pool had previously acted as a barrier.
