Mangawhai Ratepayers and Residents Association chairman Bruce Rogan has survived an attempt to unseat him.
During a recent association executive meeting a notice of motion to expel Mr Rogan from the chair was put to a vote under urgency and passed.
Mr Rogan said he understood a new chairman was not to be elected, but he would be replaced by deputy chairman Bill Bygrave serving as acting chairman.
However, the constitution states that although the executive elects the chairman it does not have the power to replace him unless the chair is vacated through death or resignation.
Also, three members of the executive - including the person who moved the proposal to oust Mr Rogan - had not been financial members of the association on Saturday and were therefore barred from holding office.
