A teenager who admitted abducting and raping a 10-year-old girl as she walked home from school could be jailed indefinitely.
Daniel Patrick Livingstone, 19, appeared for sentence in the Whangarei District Court yesterday on charges of rape, abduction and threatening to kill.
He pleaded guilty to all three charges on May 15.
However, Judge Jim Rota transferred the case to the High Court, saying there were clear grounds for that court to look at a sentence of preventive detention _ which allows for a prisoner's release only when authorities are satisfied there is no risk of further offending.
Preventive detention can be imposed for serious sexual offending or violence, where the court is satisfied that the offender would be likely to reoffend if released.
Defence lawyer Dave Sayes, who did not consent to the transfer, said any application for preventive detention would be "vigorously opposed".
A police summary of facts said Livingstone was walking along Raumanga Valley Rd on April 4 after drinking at a nearby address.
He tried the doors of a parked car and then approached the victim as she was walking to a relative's house after school.
Livingstone grabbed the victim after she ignored him and dragged her down a driveway, threatening to kill her if she screamed.
He then pulled her behind a shed, forced her to the ground and raped her, the police summary said.
After he finished he said to the girl: "Look, you've made me all dirty."
Livingstone then walked back down the driveway and the girl went to her relative's address where she was met by her mother and aunt.
The girl identified Livingstone to her mother when he crossed the road in front of them. The mother confronted him and the police later located him in Mahana Pl.
When spoken to by the police, he admitted speaking to the girl and stated that all he said to the girl was "Hi sexy", the police summary said.
The victim required medical treatment after the attack and had to undergo counselling.
Livingstone was remanded in custody to appear in the High Court on September 4 for a date to be set for sentencing.
