Phillip Frank Panzica III, 27, and Chloe Scordianos, 21,were arrested on February 5 after riding alone together on the High Roller, which is billed as "The Happiest Half Hour in Vegas."

The couple were smoking cigarettes when they refused two intercom requests to put their clothes on, and instead continued to have sex.

Riders in a nearby glass pod took video of the encounter, according to court documents.
The couple's high jinks were also captured by surveillance cameras. The images haven't been made public.

A Las Vegas judge on Tuesday set a March 9 date to see if the charges against them can be resolved without trial.

Panzica's lawyer declined to comment while Scordianos' said his client believed the couple had an expectation of privacy.
