Gable Tostee - the man whose Kiwi Tinder date plunged to her death at Surfers Paradise in 2014 - is suing the state of Queensland, claiming he was assaulted by police.
He claims he was told he was being arrested "for being a dickhead" at a Gold Coast convenience store in 2014, the Courier Mail reported.
The Queenslander, who was acquitted of New Zealander Warriena Wright's death last year, is seeking damages of $300,000.
The district court documents show he was charged with public nuisance and obstructing a police officer, which he denied. The charges were later dropped when officers found no evidence.
He claims officers arrested him as he was trying to get cash to pay the tuk-tuk driver and buy chocolate bars.
Tostee alleges one of the officers said "Do you want me to throw you on the ground?'' and the other cop told him he was being arrested "for being a f***wit" — before throwing him to the ground and using capsicum spray.
The claim alleges the police actions amount to assault and battery, false imprisonment and deprivation of liberty.
He claims police used physical force and verbal intimidation that was not justified or excused.
According to the Courier Mail, Tostee says he suffered dental damage, jaw, wrist, neck and thumb injuries, a fractured toe and post-traumatic stress disorder, of mild to moderate severity.
Queensland Police told news.com.au it is aware of the incident.
However, a spokesman said the force would not make a statement on what happened until the court proceedings were finished.
At this stage the state has not responded to the claim, which was filed on November 23.
