Police are considering laying charges against a man seriously injured in an accident at the Brass Monkey rally in Otago on Sunday.
The Alexandra man was flown to Dunedin Hospital with serious head injuries after he fell from a motorcycle, less than an hour after failing a breath alcohol test.
Central Otago and Lakes District highway patrol head Sergeant John Priebee said yesterday that police were seeking legal advice over what charges could be laid.
He said it was not illegal to drive drunk on private property and advice was being sought to establish whether the rally ground, near Oturehua in Central Otago, was covered by the law.
The man, in his 50s, was allegedly riding around the track at the rally site when he hit a pothole and lost control of the Harley Davidson motorcycle, police said.
A Dunedin Hospital spokesman said the man was in intensive care in a serious but stable condition yesterday.
