Charges of sexual violation and rape against a Murupara man on trial in the High Court at Rotorua have been dismissed.
Colin Moore Barnett, who is in his 70s, had been on trial this week after pleading not guilty to a charge of rape, three charges of sexual violation by unlawful sexual connection and one charge of doing an indecent act.
The complainant finished giving her evidence on Monday afternoon.
Justice Lang dismissed all five charges against Barnett following an application by Barnett's lawyer, Jonothan Briscoe, yesterday morning.
At the start of the trial Barnett pleaded guilty to two charges of sexual violation by unlawful sexual connection.
The charges relate to incidents alleged to have happened between September 19, 2009 and January 22, 2010 at Murupara, when Barnett was 76 and the complainant was 8.
Barnett is not a family member and is not known to the victim's family.
Justice Graham Lang remanded Barnett in custody for sentencing in the High Court at Auckland on February 3 on charges of sexual violation by unlawful sexual connection.
