Microsoft has filed formal notice to appeal a federal judge's order that it be broken up for violating US anti-trust law.
Microsoft asked the US Court of Appeals to stay a raft of business restrictions ordered by Judge Thomas Penfield Jackson last week.
Judge Jackson sided with the US Justice Department and agreed to delay a decision on Microsoft's request to stay the restrictions, saying the company need to first give formal notice of appeal.
The Justice Department is seeking to send the case to the US Supreme Court, bypassing the appeals court that has ruled in Microsoft's favour in the past.
