One of the men accused of stealing a boat before it capsized off Omokoroa point has appeared in Tauranga District Court today.
Dylan Baxter, 25, appeared in Tauranga District Court this morning.
He entered no plea on the charge of theft of boat.
He is due to reappear in court on November 12.
The other man who was charged with stealing the boat, Samuel Butler, 22, has yet to appear in court today.
Baxter and Butler and two others were on the boat when it capsized on Tuesday, October 16.
The two other men are 23-year-old Shaun Hogarth, who went missing after the incident.
His body was found yesterday near Omokoroa jetty.
The fourth man on the board, Liam Kane, made it to shore but has not been seen since the incident.
